The Appeals Process
As frustrating as it can be to receive a denial on your initial claim for SSDI or SSI benefits, there are ways in which an attorney can help. It starts by finding out exactly why your claim was denied. You should receive a notice from the Social Security Administration giving you the reason, which could include:
- Insufficient medical proof
- An impairment that is not considered severe
- A condition resulting from alcohol or drug abuse
- An impairment that will not last for more than one year
- Failure to take prescribed medications per directions
- Ability to perform the same or other type of work
If you are denied you must file a Request for a Hearing within 60 days of receipt of a denial. The next step is a Hearing and Review. I can present additional medical evidence on your behalf. I can do this for you and present an effective case on your behalf.
